Jednocze\u015bnie <strong>deklarujemy ch\u0119\u0107 spotkania z Panem Prezydentem<\/strong>, podzielenia si\u0119 naszym do\u015bwiadczeniem z pracy z cudzoziemcami i cudzoziemkami oraz rozmowy nad mo\u017cliwymi rozwi\u0105zaniami.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Uzasadnieniem rz\u0105du dla przyj\u0119cia nowelizacji ww. ustawy jest d\u0105\u017cenie do zwi\u0119kszenia bezpiecze\u0144stwa polskich granic i obywateli. Niezaprzeczalnym jest, i\u017c od sierpnia 2021 r. re\u017cimy rosyjski i bia\u0142oruski nieustannie stosuj\u0105 wobec Polski ataki hybrydowe, tworz\u0105c w tym celu sztuczny szlak migracyjny i zmuszaj\u0105c cudzoziemc\u00f3w i&nbsp;cudzoziemki z pa\u0144stw trzecich do nieuregulowanego przekraczania polskiej granicy z&nbsp;terytorium Bia\u0142orusi, m.in. poprzez niedopuszczanie ich do przej\u015bcia granicznego. <strong>Rz\u0105dowa propozycja jednak nie tylko nie umo\u017cliwi skuteczniejszego odpowiadania na te wyzwania, ale b\u0119dzie wr\u0119cz sprzyja\u0107 utracie kontroli nad przep\u0142ywem os\u00f3b przez polskie terytorium. <\/strong>Odebranie cudzoziemcom i cudzoziemkom dost\u0119pu do przewidzianej prawem procedury o&nbsp;udzielenie ochrony mi\u0119dzynarodowej to <strong>utrata instrumentu, dzi\u0119ki kt\u00f3remu polskie s\u0142u\u017cby i urz\u0119dy mog\u0105 identyfikowa\u0107, weryfikowa\u0107, a w razie stwierdzenia braku przes\u0142anek do udzielenia ochrony tak\u017ce odsy\u0142a\u0107 do kraju pochodzenia osoby, kt\u00f3re w&nbsp;spos\u00f3b nieuregulowany przekrocz\u0105 granic\u0119 i znajd\u0105 si\u0119 na terytorium Rzeczypospolitej Polskiej<\/strong>. Zlikwidowanie jedynej dost\u0119pnej obywatelom pa\u0144stw trzecich, przekraczaj\u0105cym granic\u0119 Polski w spos\u00f3b nieregularny, \u015bcie\u017cki uregulowania pobytu nie wzmocni polskiego pa\u0144stwa, a&nbsp;jedynie pozbawi je dost\u0119pu do informacji, nierzadko istotnych z punktu widzenia bezpiecze\u0144stwa narodowego. Zmusi tak\u017ce ofiary barbarzy\u0144skiej polityki Aleksandra \u0141ukaszenki i W\u0142adimira Putina do ukrywania si\u0119 przed polskimi s\u0142u\u017cbami za wszelk\u0105 cen\u0119 i pozostawania w&nbsp;tzw. szarej strefie, w kt\u00f3rej musz\u0105 zaryzykowa\u0107 korzystaniem z us\u0142ug przemytnik\u00f3w, dzia\u0142aj\u0105cych w ramach zorganizowanych grup przest\u0119pczych i bez w\u0105tpienia wsp\u00f3\u0142pracuj\u0105cych z bia\u0142oruskim i rosyjskim re\u017cimem. Korzystanie z us\u0142ug przemytnik\u00f3w dramatycznie zwi\u0119ksza ryzyko stania si\u0119 ofiar\u0105 handlarzy lud\u017ami \u2014 to ryzyko jest szczeg\u00f3lnie du\u017ce w przypadku kobiet i dzieci, kt\u00f3rych nie brakuje w\u015br\u00f3d os\u00f3b przekraczaj\u0105cych polsko-bia\u0142orusk\u0105 granic\u0119.&nbsp;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Kszta\u0142t nowelizacji budzi r\u00f3wnie\u017c <strong>powa\u017cne w\u0105tpliwo\u015bci konstytucyjne<\/strong>, kt\u00f3re na etapie prac parlamentarnych zd\u0105\u017cy\u0142a wyrazi\u0107 m.in. Krajowa Izba Radc\u00f3w Prawnych, Naczelna Rada Adwokacka, Rzecznik Praw Obywatelskich, Rzecznik Praw Dziecka, Biuro Legislacyjne Sejmu czy Biuro Legislacyjne Senatu. Ustawa <strong>ra\u017c\u0105co narusza art. 56 ust. 2 Konstytucji RP<\/strong>, w kt\u00f3rym zagwarantowano cudzoziemcom mo\u017cliwo\u015b\u0107 ubiegania si\u0119 o&nbsp;przyznanie statusu uchod\u017acy zgodnie z wi\u0105\u017c\u0105cymi Rzeczpospolit\u0105 Polsk\u0105 umowami mi\u0119dzynarodowymi, w tym z Konwencj\u0105 dotycz\u0105c\u0105 statusu uchod\u017ac\u00f3w z 1951 r. Zaproponowane przez rz\u0105d przepisy uderzaj\u0105 r\u00f3wnie\u017c w <strong>zasad\u0119 wy\u0142\u0105czno\u015bci ustawy w&nbsp;zakresie ograniczania konstytucyjnych praw i wolno\u015bci, wyra\u017con\u0105 w art. 31 ust. 3 Konstytucji RP<\/strong>. Umo\u017cliwienie Radzie Ministr\u00f3w swobodnego kszta\u0142towania zakresu terytorialnego obowi\u0105zywania czasowego ograniczenia prawa do z\u0142o\u017cenia wniosku o ochron\u0119 mi\u0119dzynarodow\u0105 za pomoc\u0105 aktu rangi rozporz\u0105dzenia to omini\u0119cie zabezpiecze\u0144 stoj\u0105cych u podstaw polskiego ustroju i porz\u0105dku prawnego. <strong>Jest to r\u00f3wnie\u017c podwa\u017cenie kompetencji Prezydenta RP<\/strong>. Do tej pory na tak daleko id\u0105ce ograniczenia praw i wolno\u015bci pozwala\u0142o jedynie wprowadzenie stanu wojennego lub stanu wyj\u0105tkowego, na kt\u00f3re niezb\u0119dna jest zgoda Prezydenta.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Prawo do azylu stanowi istotny dorobek prac nad pokojem na \u015bwiecie po dramatycznych do\u015bwiadczeniach II wojny \u015bwiatowej oraz wa\u017cn\u0105 cz\u0119\u015b\u0107 naszej polskiej historii \u2014 to dzi\u0119ki niemu Polki i Polacy mogli stara\u0107 si\u0119 o ochron\u0119 przed opresj\u0105 ze strony komunistycznych w\u0142adz PRL. <strong>Stoj\u0105c na stra\u017cy konstytucyjnych praw i wolno\u015bci oraz pami\u0119taj\u0105c o naszym narodowym dziedzictwie, wierzymy, \u017ce Pan Prezydent zechce stan\u0105\u0107 w jego obronie i odm\u00f3wi\u0107 podpisu pod uchwalon\u0105 przez Sejm i Senat ustaw\u0105<\/strong>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Amnesty International Polska<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Centrum ds.
